Bu Kullanım Sözleşmesi ("Sözleşme"), CreatedByKalyon ("Kalyon", "biz") tarafından geliştirilen tüm mobil uygulama, oyun ve web tabanlı araçlar ("Uygulama(lar)") için geçerlidir; örneğin Plus 15, Tırtıl, BallUp, Neon Shape Shot, Fly to Galleon, Godot kart oyunu, My Pro Club, My Cup Pro Football, Kalyon Menu ve Sınıf Takip. Bir Uygulamayı indirip kullanan, hesap oluşturan veya erişen her kişi ("Kullanıcı") bu Sözleşmeyi kabul etmiş sayılır. Bu Sözleşme, Uygulamanın ait olduğu kategoriye göre Bölüm 7'deki ek hükümlerle birlikte uygulanır.
Kullanıcı, verdiği bilgilerin doğru olduğunu kabul eder. Hesap güvenliğinden (şifre gizliliği dahil) Kullanıcı sorumludur. Kalyon, kötüye kullanım, dolandırıcılık şüphesi veya Sözleşme ihlali durumunda hesapları askıya alma/kapatma hakkını saklı tutar. Uygulamalar yasal amaçlarla kullanılmalıdır; başka kullanıcıları rahatsız edici, yanıltıcı veya hukuka aykırı içerik/davranış yasaktır. Hesap oluşturma gerektiren Uygulamalarda (My Pro Club, My Cup Pro Football) yalnızca kullanıcı adı ve şifre yeterlidir; e-posta yalnızca isteğe bağlı şifre kurtarma amacıyla eklenebilir.
Uygulamalar "olduğu haliyle" (As-Is) ve "mevcut olduğu sürece" (As-Available) sunulmaktadır; kesintisiz veya hatasız çalışacağı garanti edilmez. Adında "PRO" ibaresi geçen Uygulamalarda (My Pro Club, My Cup Pro Football) bu ibare, sunulan turnuva yönetimi ve istatistik takibi gibi özelliklerin gelişmiş düzeyde olduğunu temsil eder; kurumsal bir şirket garantisi veya kesintisiz hizmet taahhüdü (SaaS) anlamına gelmez. WhatsApp, Instagram veya X (Twitter) gibi küresel devlerin bile yılda birkaç kez kesinti yaşayabildiği göz önünde bulundurularak, Kalyon hizmetin tamamen kesintisiz, anlık hatasız veya veri kayıpsız olacağını garanti etmez. Uygulama içi reklam gösterimleri, sunucu maliyetlerine ve geliştirme süreçlerine katkı sağlama amaçlı bağımsız bir destek niteliğindedir. Kalyon'un sorumluluğu, yürürlükteki mevzuatın izin verdiği azami ölçüde sınırlıdır.
Olası sunucu kesintileri, sistemsel çökmeler veya teknik aksaklıklardan kaynaklanabilecek veri kayıplarını önlemek adına, bazı Uygulamalarda (My Pro Club, My Cup Pro Football) ücretsiz "PDF Çıktısı Alma" özelliği sunulmaktadır. Turnuva, puan durumu veya oluşturduğunuz diğer kritik verileri düzenli olarak bu özellikle yerel olarak yedeklemek tamamen Kullanıcının sorumluluğundadır. Yedeklenmemiş verilerden kaynaklanan aksamalardan Kalyon, yürürlükteki yasaların izin verdiği azami ölçüde sorumlu tutulamaz.
Kullanıcılar; uygulama altyapısını manipüle edemez, yapay trafik/bot istekleri oluşturamaz, kaynak kodlar üzerinde tersine mühendislik yapamaz veya uygulamayı ticari olarak kopyalayamaz. Bu tür faaliyetlerin tespiti halinde Kalyon, ilgili hesabı hiçbir ihbarda bulunmaksızın kalıcı olarak askıya alma veya silme hakkını saklı tutar.
Skor tabloları: Skor tablolarında (örn. Google Play Games skor tabloları) hile, otomasyon (bot, makro vb.), değiştirilmiş uygulama kullanımı veya başka bir yolla skor manipülasyonu tespit edilirse, Kalyon ilgili skorları silebilir ve oyuncuyu skor tablolarından çıkarabilir.
Uygulamaların tasarımı, kodu, marka ve görselleri Kalyon'a aittir. Kullanıcıya yalnızca kişisel/amacına uygun kullanım için sınırlı bir lisans verilir; kopyalama, tersine mühendislik veya yeniden dağıtım yapılamaz. Yetkisiz kopyalama veya çoğaltma kesinlikle yasaktır.
Bazı Android cihaz üreticileri, uygulama verilerini (onay tercihleri, oturum bilgileri) kendi sistem yedekleme veya senkronizasyon mekanizmalarıyla saklayabilir. Bu durumda uygulama silinip yeniden yüklendiğinde bazı tercihler (GDPR onayları, kayıtlı kullanıcı bilgileri) cihaz tarafından geri yüklenebilir. Kalyon, bu cihaz seviyesindeki davranışlar üzerinde kontrol sahibi değildir ve bundan kaynaklanan durumlardan sorumlu tutulamaz.
(örn. Plus 15, Tırtıl, BallUp, Neon Shape Shot, Fly to Galleon, Godot kart oyunu): Kalyon, oyun içi ilerleme kaybı veya sunucu kesintisinden makul çaba ilkesiyle sorumludur; kesin sonuç garantisi verilmez.
(My Pro Club, My Cup Pro Football, Kalyon Menu): Uygulamayı kullanan İşletmeci/Yönetici, kendi müşterisi/üyesiyle ilişkisinden ve sisteme girdiği verinin hukuka uygunluğundan tek başına sorumludur. Kalyon yalnızca teknik altyapı sağlar, İşletmecinin verdiği kararlardan sorumlu tutulamaz.
My Pro Club ve My Cup Pro Football için final sürüm notu: Haziran 2026 tarihi itibarıyla yayınlanan en güncel sürüm, bu uygulamaların tüm fonksiyonlarının hata tespit edilmeden çalıştığı final (son) sürümüdür. Uygulamalar gerçek kullanıcılar ve yapay zeka (AI) simülasyonları ile test edilmiş ve hata görülmemiştir; fakat yayına çıktıktan sonra farklı kullanıcı senaryolarında hata yaşanmayacağı sözü verilemez. Gerçek kullanıcıların tespit edip bize ilettikleri hatalar imkanlar dahilinde çözülmeye çalışılacaktır. Bu sürümden sonra, gelecekteki zorunlu Android/iOS versiyon uyumluluk güncellemeleri hariç, bu uygulamalara yeni bir özellik eklenmeyecek ve başka büyük güncelleme alınmayacaktır.
(örn. Sınıf Takip): Uygulamayı kullanan Öğretmen, yüklediği sınıf/öğrenci listesinin doğruluğundan, güncelliğinden ve bu veriyi yükleme yetkisinin bulunduğundan sorumludur. Kalyon bu veriyi bağımsız olarak temin etmez veya doğrulamaz.
Kalyon, uygulamanın herhangi bir özelliğini değiştirme, kaldırma veya sonlandırma hakkını saklı tutar; herhangi bir Uygulamayı önceden bildirim yapmaksızın durdurma, askıya alma veya sonlandırma hakkı da saklıdır.
Bu sözleşmeden doğacak tüm uyuşmazlıklar münhasıran Türkiye Cumhuriyeti yasalarına tabidir. Kocaeli Mahkemeleri ve İcra Daireleri tek yetkili merci olarak kabul edilir.
Sözleşme zaman zaman güncellenebilir. Önemli değişikliklerde Kullanıcıya bildirim yapılır ve gerekirse yeniden onay istenir.

This Terms of Service ("Agreement") applies to all mobile applications, games, and web-based tools ("App(s)") developed by CreatedByKalyon ("Kalyon", "we"); for example Plus 15, Tırtıl, BallUp, Neon Shape Shot, Fly to Galleon, the Godot card game, My Pro Club, My Cup Pro Football, Kalyon Menu, and Sınıf Takip (Class Tracker). Anyone who downloads, uses, creates an account for, or accesses an App ("User") is deemed to accept this Agreement. This Agreement applies together with the category-specific provisions in Section 7, based on the category the App belongs to.
The User agrees that the information they provide is accurate. The User is responsible for account security, including keeping their password confidential. Kalyon reserves the right to suspend or terminate accounts in cases of abuse, suspected fraud, or violation of this Agreement. Apps must be used for lawful purposes; content or behavior that harasses other users, is misleading, or is unlawful is prohibited. Apps that require account creation (My Pro Club, My Cup Pro Football) only require a username and password; email may optionally be added solely for password recovery.
Apps are provided on an "As-Is" and "As-Available" basis; uninterrupted or error-free operation is not guaranteed. For Apps carrying the term "PRO" in their name (My Pro Club, My Cup Pro Football), this term represents the advanced and comprehensive nature of the features provided to users (such as tournament management and statistics tracking); it does not imply an enterprise-level corporate guarantee or an uninterrupted software service (SaaS) commitment. Considering even global platforms like WhatsApp, Instagram, or X experience outages multiple times a year, Kalyon makes no warranties regarding completely uninterrupted, error-free, or data-loss-free operation. In-app advertisement displays serve solely to contribute toward server maintenance and development costs. Kalyon's liability is limited to the maximum extent permitted by applicable law.
To mitigate risks of server interruptions, systemic crashes, or unexpected data loss, some Apps (My Pro Club, My Cup Pro Football) provide a free "PDF Export" feature. Users are entirely responsible for backing up their tournament, standings, or other critical data regularly and maintaining local backups via this feature. To the maximum extent permitted by applicable law, Kalyon shall not be liable for any data loss resulting from failure to maintain local backups.
Users are strictly prohibited from manipulating the app's infrastructure, creating bot traffic, attempting to reverse engineer the source code, or duplicating the app for commercial distribution. Kalyon reserves the right to terminate any account immediately without prior notice upon detection of such misuse.
Leaderboards: If cheating, automation (bots, macros, etc.), use of a modified app, or any other form of score manipulation is detected on leaderboards (e.g., Google Play Games leaderboards), Kalyon may delete the affected scores and remove the player from the leaderboards.
The design, code, branding, and visuals of the Apps belong to Kalyon. The User is granted a limited license for personal/intended use only; copying, reverse engineering, or redistribution is not permitted. Unauthorized copying or reproduction is strictly prohibited.
Some Android device manufacturers may retain application data (consent preferences, session information) through their own system backup or synchronization mechanisms. In such cases, certain preferences (GDPR consents, saved user credentials) may be restored by the device after the application is deleted and reinstalled. Kalyon has no control over such device-level behaviors and cannot be held liable for resulting outcomes.
(e.g., Plus 15, Tırtıl, BallUp, Neon Shape Shot, Fly to Galleon, the Godot card game): Kalyon is responsible for in-game progress loss or server outages on a best-effort basis; no guarantee of a specific outcome is given.
(My Pro Club, My Cup Pro Football, Kalyon Menu): The Business/Administrator using the App is solely responsible for their relationship with their own customer/member and for the lawfulness of the data they enter into the system. Kalyon provides only the technical infrastructure and cannot be held responsible for the Business's decisions.
Final version status for My Pro Club and My Cup Pro Football: The latest version deployed as of June 2026 represents the fully functional and stable final release where all functions operate without detected errors. These apps have been tested extensively with real users and AI simulations, showing no faults; however, no guarantee can be made that other users will not experience unique issues under different real-world scenarios. Valid bugs reported clearly by real users will be addressed based on availability. Aside from mandatory future Android/iOS compatibility updates, no further feature expansions or major updates will be provided for these apps.
(e.g., Sınıf Takip / Class Tracker): The Teacher using the App is responsible for the accuracy, currency, and their authorization to upload the class/student list. Kalyon does not independently source or verify this data.
Kalyon reserves the right to modify, suspend, or discontinue any feature of the application at any time, as well as to discontinue, suspend, or terminate any App at any time without prior notice.
These terms shall be exclusively governed by the laws of the Republic of Türkiye. The Courts and Execution Offices of Kocaeli, Türkiye, shall have exclusive jurisdiction.
This Agreement may be updated from time to time. Users will be notified of material changes and re-consent may be requested where necessary.
